US Gov Website Copyright Notice
The United States government enacted copyright to protect works of the owners from being misused by others. A Copyright grants the owner exclusive rights for his work and prevents their work from being copied or used by others.
The use of a copyright notice is not necessary in U.S. law, even though it might turn out to be useful on few occasions. The former law considered the copyright notice a mandatory prerequisite. Hence, the use of notice is still applicable to the copyright of older works.
The 1976 Copyright Act had a mandatory condition of the copyright notice. However, this prerequisite was abolished when the Berne Convention was initiated in the United States.
However, it is recommended that the use of the notice may be vital because it notifies the public that the work is secured by copyright. The copyright gives identity and authority to the copyright author, and illustrates the year of first publication.
In addition, a proper notice of copyright is very helpful when it appears on the published copy of the creation. In a legal battle if a defendant who has infringed the author’s creation pleads of an innocent infringement, then no weight shall be given to such a defendant’s intervention.
As per the copyright law, the use of the copyright notice is the duty of the copyright owner. Moreover, it does not require advance permission from, or registration with, the Copyright Office. Hence, it is entirely in the hands of the author to protect his work from being violated. Therefore, the US government website encourages using copyright notice.
